Terms and Conditions

1. Definition of Terms

As used in this warranty policy, "Product" means any hardware manufactured for or by 1Goal Gear bearing the "1Goal Gear" trademark, trade name, or logo that is purchased directly from 1Goal Gear or a 1Goal Gear Authorized Reseller.

An "Original Purchaser" is any consumer that purchases and has possession of a Product directly from 1Goal Gear or from a 1Goal Gear Authorized Reseller.

An "Authorized Reseller" is any retail store that has an agreement to purchase Products direct from 1Goal Gear on an ongoing basis for resale.

An "End User" is the ultimate consumer of the Product and constitutes anyone who owns and uses a 1Goal Gear Product.

"Date of Original Retail Purchase" is the date the Original Purchaser bought the Product from 1Goal Gear or a 1Goal Gear Authorized Reseller.

2. Scope of Warranty

1Goal Gear WARRANTS this 1Goal Gear hardware Product against defects in merchandise and workmanship for a period of ONE (1) YEAR from the Date of Original Retail Purchase.

a. Products Covered

This warranty applies only to Products and Components manufactured by or for 1Goal Gear that can be identified by the original manufacture's serial number of the 1Goal Owner's Manual. The major components of your computer are covered by warranties provided by the original manufacturer. These are referred to as “MFG covered” parts. The terms and conditions of the original manufacturer’s warranty only apply to MFG covered parts and we cover labor only for replacement of MFG covered parts. A list of covered parts and components are shipped with each computer. Visiting the websites of the manufacturers listed will disclose manufacturers warranties for individual parts. Any parts not listed as being covered by the manufacturers warranty are referred to as “non- MFG covered” parts. Non - MFG covered parts will be replaced if defective during the warranty period. 1Goal Gear provides no warranty whatsoever for any software provided with its Products; such software is warranted separately by their manufacturers. 1Goal Gear does not warrant any products that are not 1Goal Gear Products. This warranty does not apply if the Product, upon inspection, displays evidence of abuse or neglect such as over-clocking, low coolant, cracks, dents or exposure to extreme moisture, dirt or heat; damage due to accident, abuse, misuse, or misapplication; if the Product has been modified without the written permission of 1Goal Gear; or if any original manufacturers' serial number has been removed or defaced.

b. Service Procedures

If you discover a defect, 1Goal Gear will, at its sole option, repair, replace or refund the purchase price of this Product at no charge except for shipping one-way, provided you return it during the limited warranty period, with freight charges prepaid to the appropriate 1Goal Gear repair department, and provided you obtain a Return Merchandise Authorization (RMA) number prior to shipping your defective Product. The RMA number must appear plainly on the outside of the shipping packaging. RMA numbers can be obtained by calling or writing 1Goal Gear at the address and phone numbers printed on this certificate. For each Product returned for warranty service, please attach your name, address, telephone number, RMA number, and a copy of your bill of sale bearing the appropriate 1Goal Gear serial numbers as proof of Date of Original Retail Purchase. All product returns must be shipped in the original packaging and be insured for the full replacement value.

It is your responsibility to complete a backup of all existing data and programs on 1Goal Gear Products prior to returning the Product to 1Goal Gear for repair under this warranty. 1Goal Gear WILL HAVE NO LIABILITY FOR LOSS OR RECOVERY OF DATA OR PROGRAMS.

THIS APPLIES TO END USERS IN THE CONTINENTAL UNITED STATES OF AMERICA ONLY (EXCLUDING PUERTO RICO, ALASKA, HAWAII, AND U.S. POSSESSIONS AND TERRITORIES). OTHERWISE, YOU ARE RESPONSIBLE FOR SHIPPING THE PRODUCT TO OUR REPAIR FACILITY AND WE WILL SHIP THE PRODUCT BACK TO YOU FREIGHT COLLECT.

1Goal Gear will provide return shipping after repairs but 1Goal Gear IS ONLY ABLE TO PROVIDE RETURN SHIPPING TO THE END USER FOR THOSE END USERS WITH AN ADDRESS IN THE CONTINENTAL UNITED STATES.

3. 1Goal Gear's Limited Warranty Obligations are Limited to the Terms Set Forth Below:

THE WARRANTY AND REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHERS, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED. 1Goal Gear SPECIFICALLY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. NO 1Goal Gear DEALER, AGENT, OR EMPLOYEE IS AUTHORIZED TO MAKE ANY MODIFICATION, EXTENSION, OR ADDITION TO THIS WARRANTY.

1Goal Gear IS NOT RESPONSIBLE FOR SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOST PROFITS, DOWNTIME, GOODWILL, DAMAGE TO OR REPLACEMENT OF EQUIPMENT AND PROPERTY, AND ANY COSTS OF RECOVERING, REPROGRAMMING, OR REPRODUCING ANY PROGRAM OR DATA STORED IN OR USED WITH 1Goal Gear PRODUCTS.

Some states do not allow the exclusion or limitation of incidental or consequential damages or exclusions of implied warranties, so the above limitations or exclusions may not apply to you. This warranty gives you specific rights, and you may also have other rights that vary from state to state.

4. Governing Law

This limited warranty policy shall be governed by and construed in accordance with the laws of the State of Ohio. Any litigation under this agreement shall be resolved in the trial courts of Butler County, State of Ohio, which shall have exclusive jurisdiction on this matter.

Warranty and Service

All systems and notebooks include a standard 1-year warranty and extended warranty options are available on some of the gear. Notebooks include lifetime tech support. Desktops include 90-days of tech support. Optional services include nationwide onsite installation and support services, live remote Internet support services, Windows support and system upgrade support. We can provide turn key systems that are setup to work and loaded with all of your software and files. CV Solid 4.0 can be installed at no cost on most of the gear. Prices for optional services are currently provided by quote. We offer Vista upgrade services for computers that are less than two years old.
